By accessing or using ModelJockey ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
You must be at least 18 years of age to use the Platform. By using ModelJockey, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
If you are accessing or using the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
ModelJockey is an online marketplace that connects AI professionals ("Jockeys") with businesses and individuals ("Clients") seeking AI implementation talent. The Platform facilitates discovery, communication, contracting, and payment between Jockeys and Clients.
ModelJockey is a platform facilitator only. We are not an employer, staffing agency, or joint venture partner. We are not a party to the contracts formed between Jockeys and Clients. The working relationship, deliverables, and terms of engagement are solely between the Jockey and Client. ModelJockey does not supervise, direct, or control the work performed by Jockeys.
ModelJockey does not guarantee the quality, accuracy, or completeness of any work performed through the Platform, nor do we endorse any particular Jockey or Client.
To use the Platform, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
ModelJockey reserves the right to reject, suspend, or terminate any account at its sole discretion, including for suspected fraud, misrepresentation, or violation of these Terms.
As a Jockey on the Platform, you agree to:

ModelJockey charges a service fee of 10–15% on all contract payments. This fee is deducted from the Jockey's earnings before payout. The exact fee rate may vary based on contract type, tier status, and other factors as determined by ModelJockey.
All payments are processed through Stripe Connect. By using the Platform, you agree to Stripe's terms of service and privacy policy. Jockeys must complete Stripe Connect onboarding to receive payouts.
Fixed-price contracts use an escrow system with milestone-based payments. Clients fund escrow at the start of each milestone. Funds are released to the Jockey upon Client approval of the completed milestone deliverables.
Hourly contracts are billed based on time entries submitted by the Jockey and approved by the Client. Charges are processed upon Client approval.
ModelJockey does not withhold or remit taxes on behalf of users. You are solely responsible for determining and fulfilling your own tax obligations, including income tax, self-employment tax, sales tax, or any other applicable taxes.
To maintain the integrity of the marketplace and protect all users, all project-related communication and payments between Jockeys and Clients must occur through the Platform.
The Platform uses automated contact information detection in messaging to help enforce this policy. Violations of the anti-circumvention policy may result in warnings, account suspension, or permanent termination.
Unless otherwise agreed in the contract between Jockey and Client, ownership of work product created under a contract transfers to the Client upon full payment. Jockeys retain rights to any pre-existing tools, frameworks, methodologies, and general knowledge used in performing the work.
Jockeys may display completed work in their ModelJockey portfolio unless the Client has requested confidentiality as part of the contract terms. Portfolio display is limited to showcasing capabilities and does not constitute a transfer of ownership back to the Jockey.
ModelJockey retains all rights, title, and interest in the Platform, including its design, features, branding, trademarks, and proprietary technology. You may not copy, modify, distribute, or create derivative works of any Platform content or technology.
You are solely responsible for all content you create, upload, or share on the Platform, including profile information, portfolio items, forum posts, reviews, messages, and file attachments.
Reviews must be honest and based on actual contract experience. Both Jockeys and Clients may leave reviews within 30 days of contract completion. Reviews cannot be edited or deleted by the author once submitted.
ModelJockey reserves the right to remove any content, restrict access to features, or take other moderation actions at its sole discretion. Users may report content that violates these Terms. Moderation actions may include warnings, content removal, or account suspension.
The Model Test Track is a community-driven challenge system where Jockeys can demonstrate and verify their skills. By participating, you agree to the following:
In the event of a disagreement between a Jockey and a Client, both parties should first attempt to resolve the issue directly through Platform messaging.
If direct resolution is not possible, either party may file a formal dispute through the Platform. Only active contracts may be disputed, and only one open dispute is allowed per contract at any time.
ModelJockey may review disputes and, at its discretion, take one of the following actions:
ModelJockey is not obligated to investigate or resolve every dispute. ModelJockey's dispute resolution decisions are final within the Platform context.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the maximum extent permitted by law, ModelJockey shall not be liable for:
In no event shall ModelJockey's total aggregate liability exceed the total fees paid by you to ModelJockey in the twelve (12) months preceding the event giving rise to the claim.
You may close your account at any time through your account settings. Outstanding contracts and payment obligations survive account closure — you remain responsible for any pending payments or deliverables.
ModelJockey may suspend or terminate your account at any time for violations of these Terms, suspected fraud, or any other reason at its sole discretion. We will make reasonable efforts to notify you of the reason for suspension or termination.
Suspended or banned users may not create new accounts. Attempting to circumvent a suspension or ban by creating a new account is a further violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved in the state or federal courts located in Delaware.
ModelJockey reserves the right to modify these Terms at any time. Material changes will be communicated via email notification or prominent notice on the Platform at least 30 days before they take effect.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
